Mendocino Railway Property and Visitor Rules

These Property and Visitor Rules (the “Rules”) apply to every person who enters Mendocino Railway (“MRY”) property or uses any MRY service, including ticket holders, annual pass holders, and their guests. By entering MRY property, each visitor agrees to these Rules. MRY may change these Rules at any time without notice.

Private Property; Entry and Screening. MRY property is private property. As a condition of entry, MRY may inspect bags, parcels, and other items, and may refuse, remove, or otherwise deal with any item or person it considers unsafe, unlawful, or disruptive, in its sole discretion.

Prohibited Items. Prohibited items include firearms, ammunition, and weapons of any kind; objects that appear to be weapons; illegal drugs and cannabis; fireworks and other explosive or flammable items; outside alcoholic beverages; and any other item MRY designates as prohibited.

Conduct. Visitors must not enter tracks, rights-of-way, restricted areas, equipment, or employee-only areas; board or disembark except when instructed; interfere with railroad operations; harass, threaten, abuse, or endanger any person; engage in unsafe, disruptive, or unlawful conduct; damage property; or engage in unauthorized solicitation, sales, or commercial photography. Visitors must comply with all posted rules, safety signage, and crew instructions, and with smoking and fire restrictions (smoking only in designated areas).

Alcohol and Age-Restricted Service. Guests must be 21 or older with valid government-issued photo identification to purchase, possess, or consume alcohol. MRY may refuse or discontinue alcohol service to any person who is or appears to be obviously intoxicated, under the influence of alcohol, cannabis, or any drug, under 21, unable to produce valid identification, or furnishing alcohol to a minor or an obviously intoxicated person. Outside alcoholic beverages are not permitted.

Minors. Minors must be accompanied and supervised by a parent, legal guardian, or responsible adult where required by MRY policy or applicable law. The accompanying adult is responsible for ensuring minors follow these Rules and all safety instructions.

Photography and Recording Consent. By entering MRY property or participating in any service or experience, each visitor consents to being photographed, filmed, or recorded by MRY and to MRY’s use of that image, likeness, and voice in any media and for any purpose, without compensation, except where prohibited by law.

Removal; Refusal of Entry. MRY may refuse entry to, refuse service to, or remove or eject any person who violates these Rules, any posted rule, or any crew instruction; who is or appears to be intoxicated, under the influence of or using illegal drugs or cannabis; who is disorderly, threatening, harassing, violent, unsafe, indecent, or endangering to any person; who uses offensive, indecent, or profane language or behavior; who is not wearing adequate clothing, including shoes and a shirt; or whom MRY determines should be refused or removed to protect the safety, security, comfort, or enjoyment of others, or if MRY considers the circumstances otherwise so require, in its sole discretion. Refusal of entry, removal, or ejection does not entitle the person to any refund, credit, or compensation, except as required by law.

Changes and Closures. MRY may change operating hours, close all or part of its property or services, or limit access at any time, in its sole discretion, without notice or liability, where it considers the circumstances so require.

Personal Property. MRY is not responsible for lost, stolen, or damaged personal belongings or property, except as required by law.

Assumption of Risk; Reservation of Rights. Entry onto MRY property and participation in rail and related experiences involve inherent risks, which each visitor assumes. Nothing in these Rules waives, limits, or alters any railroad, common-carrier, public-utility, federal-preemption, jurisdictional, limitation-of-liability, assumption-of-risk, or other right, defense, or limitation available to MRY under applicable law.
